The New Zealand Promoters Association Incorporated (“NZPA”) represents the majority of the contemporary concert and festival promoters in New Zealand.

The NZPA TRUST TICK™ (full trademark registration pending) has been established to convey to the public, performers and suppliers that the Registered Member of the NZPA promoting an event displaying the NZPA TRUST TICK logo (also known as a “mark”) will adhere to the highest ethical standards in the production and promotion of the event as set out in the NZPA Code of Conduct http://www.nzpa.nz/code-of-conduct.html, including observing all the requirements of the Fair Trading Act 1986 and the Consumer Guarantee Act 1993.  The promoter is solely responsible for ensuring all obligations involved with an event displaying the NZPA TRUST TICK logo are fully met, subject to the conditions of or defaults under supplier or ticketing contracts the promoter has entered into for the event.
The public, performers, and suppliers can be confident in purchasing tickets or in all dealings with the promoter of any event displaying the following NZPA TRUST TICK logo’s on event advertising.

Use of the NZPA TRUST TICK does not restrict in any way the rights, protections and legal remedies of consumers provided by the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.  Any complaints and claims against a promoter for non-compliance with any conditions of these Acts should be lodged with the promoter and the Commerce Commission.

The members of the New Zealand Promoters Association Incorporated (“NZPA”) are contemporary and reputable concert, festival and entertainment promoters in New Zealand (each a “Member” or collectively, the “Members”).
The NZPA TRUST TICK is for use only by Members of NZPA to display on all advertising and other public facing media for a Member’s promoted event or events (an “Event” or “Events”) to convey to the public that the Member is required to uphold all the principals of NZPA’s Code of Conduct (the “Code”), including but not limited to the observance of the Fair Trading Act 1986 and Consumer Guarantees Act 1993 with respect to advertising and the sale (or where applicable, the refund) of tickets to Events.
Notwithstanding the use of the NZPA TRUST TICK by its Members, the NZPA itself is not a party in any way party to the promotion or production of individual Events, or the sale of tickets to those Events. The NZPA, its representatives and providers of information, do not guarantee the Events or accept any liability (whether direct or indirect), for any reason whatsoever, including for any loss or damage, which may in any way arise from the Events, any advertising of the Events, ticket sales, or the failure of a Member to fulfil all their obligations under the Code or in law.

TERMS OF USE FOR NZPA MEMBERS USING THE NZPA TRUST TICK MARK
The NZPA grants Members a revocable, non-exclusive licence to use the NZPA TRUST TICK for the purpose of identifying themselves as a Member of the NZPA.  All use of the NZPA TRUST TICK mark, and the goodwill generated from such use, accrues to the exclusive benefit of the NZPA.  Members will use the NZPA TRUST TICK mark in accordance with the NZPA’s guidelines (as notified to Members by NZPA).  Members may not:
a)     Use the NZPA TRUST TICK mark in a misleading manner, or in a manner that harms the reputation of NZPA;
b)     Suggest that the Member represents, acts on behalf of, or is endorsed by the NZPA without express prior written permission from NZPA; or
c)     Challenge the validity of ownership of any trademarks filed or registered for the NZPA TRUST TICK mark by NZPA, or assist anyone to do so.
The NZPA may revoke any applicable licence for the use of the NZPA TRUST TICK mark immediately by giving written notice to a Member who has, in NZPA’s opinion, breached these terms.  Once notice is given, the Member must immediately cease all use of the NZPA TRUST TICK mark and if required by the NZPA delete or destroy all materials in its possession bearing the NZPA TRUST TICK mark.
